These Terms of Use are defined by:

  • Site: It represents all developed pages, including subdomains, applications for smartphones, tablets or any support not yet defined, as well as all the services associated with the developers of Homelog.be.

  1. Homelog.be is an internet platform for placing ads for free or paid and available to the general public. These ads are placed with or without an address in a listing displayed and available to the general public. All information encoded by the advertiser may be visible unless otherwise noted. The information made public can not be controlled by the site. Only the advertiser is responsible for errors and legal implications of the information transmitted.
  2. Homelog.be does not own the advertised property and is considered as an internet platform provider on which ads can be placed. Regarding the property placed on the site, Homelog.be sells nothing, provides nothing, does not control anything, does not manage anything. Advertisers are solely responsible for their services and information. In case of completed transaction or not, Homelog.be does not intervene in the contractual relationship between the parties. The site is not a real estate agent and does not act as an agent on behalf of the advertiser or the user.
  3. Homelog.be does not guarantee the quality of the ads, the quality of the information transmitted and the legality of the publications.
  4. Homelog.be disclaims any liability to the user. The user acting on his own behalf and not on behalf of the site.
  5. Homelog.be advertises ads to increase their visibility. The information will therefore be published in other promotional media.
  6. Homelog.be may contain external links whose conditions of use may be different.
  7. Homelog.be can not be held responsible for published information.
  8. Homelog.be can not ensure the availability and accessibility of the site and its data in relation to the use of the Internet. The site, for maintenance or other reasons may make access to all or part of the site unavailable for an indefinite period.

  3. You are not allowed to transfer your account to a third party without informing Homelog.be
  4. You are prohibited from transmitting your username and password to a third party.
  5. In the case of a real estate agency with several delegates it is possible to group different accounts in a single agency. The first member will be appointed as manager of the agency. Any change of role can be done via support@homelog.be

 

  1. Content:
  1. The user may, at his sole responsibility, create, upload, publish or store content on Homelog.be
  2. You acknowledge that the content recorded on the site by you is likely to be protected by copyright, trademark rights or any rights. You disclaim any liability of the site to third parties claiming any rights whatsoever. By publishing on Homelog.be you transmit your rights whatever they are and in some ways that they have been acquired at the site.
  3. You may not reproduce, adapt, modify or create works owned by third parties without their prior consent. The site considers that you respect these rules and laws in force and is totally discharged by you against any recourse.
  4. Homelog.be allows you to view and download content accessible only for your personal and non-commercial use.
  5. You grant Homelog.be a worldwide, non-exclusive, royalty-free, irrevocable, perpetual and assignable license of the content placed by you on the site.
  6. Homelog.be can not verify the validity of the choice of the advertiser and counts on the honesty of the members of his community. You guarantee to Homelog.be, under your sole responsibility, the selected choice, to be either:
    1. A landlord: You have a formal title to the property advertised for sale or lease at the date of its publication. You are in any case considered as an ultimate economic beneficiary
    2. A real estate agent: you have access to the profession and are mandated in writing by the owner or the economic beneficiary for the realization of a property advertised on the site by you
    3. A spotter: You advertise a property for which you have no economic interest. In any case you will not have the result of the sale or lease, can not be in contact with a prospective amateur and validly negotiate. Your only interest is to provide the Homelog.be community with additional information on the market and its news. You can also intervene in the interest of an advertiser owner or real estate agent without receiving any remuneration.
  7. In any case, you are prohibited from publishing, loading, transmitting content:
    1. Fraudulent, deceptive, defamatory, false, slanderous, obscene, pornographic, vulgar, shocking and all that is prohibited by law
    2. Inciting discrimination, fanaticism, racism, intolerance, hatred, harassment, violence, harming a person or a group of people.
  8. Homelog.be will cut any link related to point 5.g. in case of non-compliance or reported by a third party.

 

  1. Fees

Homelog.be may charge a fee to users for the service offered. These services may be subject to change in both content and pricing. The related taxes are dependent on the legislation of the place of residence or publication of the announcement and subject to modification and adaptation. All amounts shown are exclusive of taxes. Fees are payable in advance.

 

  1. A publication with an address displayed: The service is free for anyone who publishes information on a property for which he identifies the exact address.
  2. A publication with the masked address: The service is paid for any publication without public display of the exact address. The price is
    1. 0,33 € / day excluding taxes. Prepayment is required prior to publication. You must charge your portfolio a minimum amount equal to the desired number of days for the publication, multiplied by the number of properties to be published. We will count the number of days in your wallet.
    2. It is possible that the address is displayed despite this desire to not display address in the event that another advertiser publishes the same property and decides to display the address.
    3. The paying advertiser is responsible for the number of days of unaddressed publication. Without credit from his wallet, the ad will be disabled. The advertiser can always reactivate the property with or without an address displayed (by crediting his wallet) by returning to his dashboard.
  3. A publication with the price displayed: The service is free for anyone who publishes and loads information about a property for which he identifies the exact price.
  4. A publication with the hidden price: The service is paid for any publication without public display of the exact price. The price is

  5. A publication from a professional real estate management software, of the type Whise / Esimmo / Omnicasa, a subscription is required. The subscription does not take into account that the goods are published with or without price / address and gives right to a personalized website:
    1. H50 = € 150.00 excl. From 1st property and up to 50 properties published during the year.
    2. H100 = 250,00 € VAT included. From the 51st property and a maximum of 100 properties published during the year.
    3. H250 = 400,00 € VAT included. From the 101st property and a maximum of 250 properties published during the year.
    4. H + = 750,00 € excl. From the 251st property and a maximum of 1,000 properties published during the year.
  6. Publication fees and services are mentioned before payment with taxes included. Each will be able to find on his dashboard of his created account, the invoice (s) downloadable (s). Unless otherwise stated, publication fees and services are non-refundable.

 

  1. Special conditions for advertisers

 

  1. As an advertiser, you will be asked for the most complete information possible on your identity, on your quality of advertiser, on your good to announce. You are responsible for the information thus communicated and ask that you keep it updated as soon as possible.
  2. You are solely responsible for the price you post and therefore communicate to users. Homelog.be does not intervene in the negotiation and can not therefore act in case of conflict with a possible amateur. Unless otherwise stated in the description of the advertisement, you are required to accept the price indicated if the amateur offers it to you. The price displayed does not take into account any charges and taxes.
  3. The images and descriptions (more generally, the information that the user can read on homelog.be) must be the most faithful to reality. Homelog.be reserves the right to delete or modify, partially or totally, information that does not comply with current legislation, that does not correspond to reality or that would be placed for the purpose of misleading the user.
  4. The insertion and ranking of ads is based primarily on geolocation. When an advertisement is similar (The criteria defining the similarity are: the address, the type of property, the floor, the surface) to another already existing, these will be grouped together in order to facilitate the search for the user . An order will be defined by the following conditions:
    1. The publication timeline
    2. The address is displayed
    3. Completion rate (all information provided) of the highest ad
  5. On the map are included ads displaying the property's address. An information sheet exists on the basis of the data included in the advertisement.
    1. In the case of a plurality of advertisements on the same property, at the same address, the same floor, the most relevant data of the advertisements are taken back.
    2. In the case of a plurality of advertisements at the same address, a single sheet containing the information is created. This is precisely the case for apartments in the same building. This allows the user to immediately know the properties for sale or rent in this building.
  6. When an identical property is announced several times by different advertisers, it is possible that the information indicated is different. We advise each advertiser to verify the information, to modify, supplement or delete the incorrect or incomplete or erroneous data.
  7. As an advertiser, you can advertise as many properties as you want as long as you have the same quality as an advertiser. As a reminder, advertisers are either:
    1. Owner: You can own multiple properties. You can keep a single account to announce them.
    2. Real estate agent: You have mandates, you are a professional, you can advertise by the same account all properties for sale or rent.
        1. If you are a real estate agent who is dependent on a real estate agency, you can ask us to join your account with the one of the real estate agency for which you work via the profile editing form.
        2. You are a real estate agency with several real estate agents, you can ask us to create as many accounts as you have real estate agents at your services.
    3. Spotter: You can advertise as much as you want. You can advertise real estate owned by others for the purpose of helping them find the nonprofit amateur. You can not consider yourself a real estate professional, this being regulated by law. You can keep a single account, allowing you to manage all spoiled goods and track their activity. When you have spotted a property, none of the encoded information will be made public, they must first have the approval of the advertiser informed by you.
      1. If the advertiser refuses, your ad will never be published and will be removed from your dashboard
      2. If the advertiser agrees, he takes over the right on the advertised property and you will not be able to modify it, it is the advertiser mentioned who will do it as he wishes.
      3. If the advertiser does not react to the information you have given them, your ad will be made public after 48 hours.
  8. Announcing a property you are mandated or owning does not prevent you from remaining responsible for the property. We advise you to keep the insurance ad hoc to avoid litigation until its realization.
  9. We advise our advertisers to pay attention to images and information published on or in which mention is made of the property of others. Some buildings are classified and the shooting is subject to prior approval of the owners of the rights concerned. When photographing a building and you own only one apartment, you must have the agreement of the trustee or the board of managers to display the other facades.
  10. It is very important to detail as much as possible the quality of the building sold or rented and its actual allocation.

  2. You do not have to create an account for the consultation but it is recommended
    1. As a registered user, you will be asked for the most complete information possible about your identity. You are responsible for the information thus communicated and we ask you to update it as soon as possible. The login and password are stored, saved and protected by Homelog.be. It is possible that information about you, we reach the connection via the formulas 1, 2 and 3, chosen below. We store and protect this information in order to provide you with an optimal service. Connection is possible by:
      1. Facebook: It will facilitate your connection because the same login and password will be taken and saved for you.
      2. Google: It will facilitate your connection because the same login and password will be taken and saved for you.
      3. Linkedin: It will facilitate your connection because the same login and password will be taken back and saved for you.
      4. Windows: It will facilitate your connection because the same login and password will be taken and saved for you.
      5. Personal: You can create a login and password independently of all your other accounts for access to Homelog
    2. You are solely responsible for the searches that you record and these will be kept on your account. Homelog.be will use your data and encoded information to send you by email the most relevant goods.
    3. You can communicate with the various advertisers:
      1. Internal messaging: Only when you are logged on Homelog.be. We store and record these communications in order to:
        - allow you to find them in your dashboard
        - allow Homelog a possible reading in case of conflict or inappropriate conversations.
      2. Phone: In most cases, the advertiser displays their phone number. You are free to contact the advertiser but you can not make commercial use of this data.
      3. External Messaging / Email: Only when you are logged in on Homelog.be. You can send a message to an advertiser who is not a member of the Homelog community, in which case your email address is sent to the person you have contacted for the sole purpose of allowing them to reply to you.
  3. It is recommended that each user read and consult all the information provided on the homelog.be website and on each of the announcements before communicating or visiting with the advertiser.
  4. Homelog.be can not be held responsible for the organization of the meetings organized between the parties.
  5. Homelog.be can not be held responsible for the quality of the advertisers and their presentation both on the homelog.be website and the real estate itself.
  6. The prices indicated are mentioned generally excluding taxes and charges.
     
  1. Clauses of abuse

It is possible to all people to report an abuse on a property advertised. You can only report this abuse by logging in with your account. We will verify the validity of your information defined either by:

  1. This property is not for sale / for rent: We kindly ask you to inform us about your quality of informant to better respond to your request.
  2. This announcement contains an error: We kindly ask you to inform us about your quality of informant and to specify the error contained in the announcement.
  3. This property does not exist: We ask you to inform us about your quality of informant to better respond to your request.

 

  1. Measures

In the case of violation of the present conditions or of hindering the legislation in force, Homelog.be reserves the right to carry out the following actions without advance notice:

 

  1. Suspend an account or an ad
  2. Edit an account or an ad
  3. Delete an account or an ad
     
  1. Litigation and arbitration agreement

Homelog.be undertakes to resolve all disputes concerning it as soon as possible. Before starting any procedure, each of the parties agrees to follow the order defined below:

 

  1. The injured party must first send an email to support@homelog.be, we will treat your problem with the utmost consideration.
  2. If we do not reach a favorable conclusion for the parties, they undertake to agree to create a binding arbitration commission. It will consist of three people with the necessary knowledge to settle the dispute:
    1. Each party appoints an arbitrator
    2. Each of the two arbitrators appointed by the parties, appoints a third party as arbitrator
    3. The parties shall comply with the decision, unanimously, of the arbitrators composing the commission
  3. The parties acknowledge and agree to waive the right to a court for the resolution of a dispute. The referee commission, described above, will not be able to handle contentious situations on behalf of several people but only one.
  4. Each users and advertisers are invited to leave comments to Homelog.be for the purpose of analysis and improvement of the platform. This information will remain confidential and for internal use only.
     
  1. General
     
  1. These conditions, under conditions and laws in force that complete them eventually constitute the agreement between the parties namely Homelog.be and all persons using the platform. This replaces all the previously agreed agreements.
  2. The persons using the platform are in no way considered to be self-employed, salaried or generally having a contract with Homelog.be.
  3. In case of invalidity, invalidity or inapplicability of any of the clauses contained in these conditions, all the other clauses and conditions remain in force and are not canceled.
  4. It is forbidden to assign, share all or part of this contract, your rights and obligations to a third party without the prior written consent of Homelog.be. Your right to delete your account remains unchanged and in this case you will no longer respect these conditions.
  5. All notices or other communications authorized by these terms are made with your consent.
